will this mean suspects will be set free in a period mentioned as they are still innocent till proven guilty or they will be remanded on guilty till proven innocent?whats your take fellow members?
No murder trials for two years

The trial of murder suspects in the country has been halted for about two years due to lack of funds for operational costs, The Nation has learnt. A High Court source told The Nation last week that while other cases are being heard, most murders cases have not been tried for the past two years as they are waiting for funding. Supreme Court and High Court Registrar Slyvester Kalembera confirmed the development in an interview on Sunday. “Yes, it is true. You know murder cases are costly because we use the jury system and the trial takes place where the crime was committed. This means the judges, lawyers and other court officials have to travel to districts for the sitting,” said Kalembera. “We have always been assisted by donors but now we are also looking at using our own funds. But the willingness from donors is still there, we are currently working on modalities on how to get the funding,” said the registrar.

let them wait for justice and its up to them to claim unlawful arrest after winning the case.In most cases murder cases are direct courts only rubber stamp.

this is myopic thinking,have you ever heard of miscarriage of justice?What you are doing is implying that all those arrested and on remand now are all guilty.Some of them have spent many years behind the bars for a crime they did not commit just because they have not been heard.There is a guy at Maula Prison who is in his 5th year on remand for killing a Chiefs chicken,do you honestly believe that if his case went before the courts and say he is found guilty for breach of peace,would he be given a custodial sentence of five years or a fine?Justice delayed is justice denied.Think!!
The truth is that if you are poor,justice will come to you very late indeed unlike the rich and famous of the land.Our justice system needs a complete overhaul because it does not make sense for the government to spend MK25 million hiring a lawyer from the UK to prosecute one person,Cassim Chilumpha in the constructive resignation case that the government cant win at all costs yet we have the poor languishing in our prisons without even the chance to appear before a judge for preliminary hearing,sad indeed.

Ngwazi,you have raised very hard hitting points in your posting,but dont you think the overhauling of our justice system depends on the masses,if malawians fight for justice instead of sitting phwii waiting for the government they need to take a stand,there is always a violation of the contitution and abuse of power not mentioning the miscarriage of justice.am not a lawyer but the way i understand human rights,you cant remand someone for two or more years without trial thats an infringement of his or her rights.
look at the frenzy caused when madonna adopted a malawian child,child rights groups jumped to the defence of the kid's rights because of publicity,but that boy has been in poverty from adam,and they didnt make any noise,now it takes a famous musician to spark a debate on child rights,how many children are orphaned and deprived in malawi?yet these human rights group sit back and watch without acting,i think malawians still dont know what their rights are,they dont know what to fight for.our justice system is screwed because of politictians meddling with its affairs,i thought the judicial was an independent dimension of our government.yet it fails to protect the masses from abusive politictians.thats what malawians should fight for.
look what happens in america or europe,people run riots when the government fails to acknowledge their human rights and protect them.we need to restructure and refurbish our society by fighting for our rights,a complete reconstruction of our political system is what we need,then these politictians will feel our pinch.serve and protect the masses or die.
