Three held, Misa chief suspended over theft story

E-mail this story to a friend  Printer friendly view of this page

A simple theft of a laptop from a hotel room ended up with three journalists being arrested for allegedly implicating the Malawi attorney general in their story, writes Samuel Makaka.
@import url("./editor-adm/style.css");

It all began when the laptop of a Reuters correspondent, Edson Chagara, was stolen in Lilongwe.

Some days later the laptop was found being offered for sale by Charles Simango, the director of the National Media Institute of Southern Africa (Namisa). This was when the Chronicle Newspaper got interested and began following the story.

The Chronicle says it found out that not only Simango was involved in the deal, but also the attorney general, Ralph Kasambara. The paper said Simango got the laptop from Kasambara, a personal friend, to sell it on his behalf.

The newspaper alleged that the Attorney General confirmed in an interview that he had given Simango the laptop to sell, saying it belonged to a friend, a Joe Phiri.

When the Chronicle phoned Phiri, he too claimed a chain of others he alleged were involved.

When the story came out in the Chronicle Newspaper, the attorney general asked the newspaper to retract the story and apologise. The Chronicle, however, stood by their story.

The AG then complained to police who arrested Rob Jamieson, the editor-in-chief, the editor, Dickson Kashoti and Arnold Mnelemba, the reporter who wrote the story.

They were released on bail the following day after being charged with criminal libel.

Namisa has suspended Simango over the scandal.

Addressing a press briefing on the developments, Namisa chairperson, Lewis Msasa said:  “The meeting condemned the arrest as it makes a mockery of democracy. We feel this was intended to muzzle the press on any issues to do with the Attorney General and his office.”

While calling upon the AG to stop the case, Msasa said that they have agreed to provide legal assistance if it continues.

Malawi News 22 October 22-28, 2005
By Caroline Somanje

Attorney General [AG], Ralph Kasambara yesterday morning failed to appear before Blantyre Magistrate's Court to answer charges of impregnating 22-year told Rubina Kawonga who has since sued him. Kawonga, who is married to Thomson Kawonga, is seeking money for the maintenance of her unborn baby boy and herself following the"disappearance of the AG since four months into the pregnancy." She is now eight months pregnant.

Rubina has since been kicked out of her parents' home in Mpingwe where she had been staying since her husband left for the UK in February 2003. Her husband has since threatened to divorce her in February next year when he comes to visit and take custody of their matrimonial child, a two-year-old boy and Kawonga's first born.

A court summons dated September 13, 2005, and signed by Chief Resident Magistrate David Kadwa commanded Kasambara to appear before the Court at 9 hours in order for the Court to adjudicate on the matter. After an hour of waiting for Kasambara to show up, Kadwa privately called Rubina to his Chambers where he told her that the AG failed to make it and that his Lawyer, Chifundo Ngwira, would Represent him instead.

The Blantyre Magistrate's Court started hearing the Case in Camera in the afternoon yesterday and Reporters were not let in and neither were they allowed to Report on the proceedings. But in an interview at the Court yesterday morning, Rubina, accompanied by two friends said she had been rendered destitute and is currently staying with a friend who is not ready to look after her and the baby once it is born.

"Since my pregnancy, I cannot afford Ante-natal care therefore I do not go to the hospital, I do not have a single nappy or vest yet my baby is due next few months and I used my other child's maintenance money from my husband to buy maternity wear.

"All I am asking for is Financial help because I quit my job after he promised to fend for me. He promised me a Car, house and care in case I became pregnant only to abandon me now," said Kawonga. She said Kasambara treated her so well at the beginning and she saw no reason to doubt and even "started falling in love with him".

Rubina is, among other things, seeking financial support for the purchase of a residential house, hospital expenses, education expenses for the offspring till it is 21, Life Insurance Cover for herself and the offspring, damages and any other relief as the Court deems fit.

Rubina [Nee Alibaba] says she met the AG at Blue Elephant Club on February 13, 2004 where Kasambara obtained her Cell phone number. She fell pregnant in March.

A daughter of former Masaf boss, Sam Kakhobwe, has been
raped at Attorney General Ralph Kasambara's residence in
Lilongwe, family sources of Kakhobwe have confirmed.

Kakhobwe's daughter (name withheld) was invited by
Kasambara to his residence. Kasambara is keeping some
"thugs" of Tanzanian and Rwandan origin at his home.

The boys are smuggling cocaine. At the house, there
was also a UDF MP, a friend of Kasambara's. The daughter
of Kakhobwe was reportedly given cocaine and gang raped.

The UDF MP apparently tipped-off Kakhobwe who came to
pick up his daughter for a medical check up which confirmed the
brutal rape.

When Kakhobwe approached Kasambara, he was threatened
with arrest and that he will use ACB to probe him why
he built a maginificient house near New State House in
Lilongwe.

Kakhobwe is living in fear even his other daughter
Penelope, who is a journalist for The Nation newspaper,
has been threatened not to publish the story.

The Nation newsroom crew are strategising on how to
publish the story as we speak.

Meanwhile, the First Lady Ethel Mutharika has sued The
Nation for defamtion on an article which claimed that
Ethel shopped in an expensive Scotland shop.

Nation reporter Mabvuto Banda who wrote the story
has been threatened with an arrest and to be charged
with Criminal Libel.

The Nation have source CCTV footage from Scotland which
captured Ethel shopping with her daughter Tapiwa.

The position of attorney general requires intergrity in all capacities. Obviously our man here was inteligently challenged when it came to conducting himself in regard to his esteemed position and left a lot to be desired. We dont want such type of people in our government. Good job.  Bingu you are indeed the man.

Any way this is a lesson to Bingu akamapamga ma appointments chifukwa  I read a certain Indian article in which the Supreme Court Of Appeal Judge was quoted " there is no way a Rapist, a Thief, Armed Robber, Terrorist, Defiler, Fraudster, or any other person involved in criminal activities can be a Judge, a minister in government, a police officer or Attourney General". The appointments being made by Bingu will always haunt him if he does not check the previous history of the people he wants to put in high positions in his government.

Right now one of the ministers he appointed zikumveka kuti he was jailed for four years in Scotland for bribery. Which really makes me wonder what type of people are in executive with a lot of scandas which yet to be known.
